The Myth of the Continuity in Colombia

Abstract

Many of the traditional Roman Law Scholars inclined theories conceive contemporary Colombian law as the result of the Roman law. Such theories sustain as well, that the ancient Roman law has survived the pass of the centuries until present time through a linear path of evolution and historical continuity. Nevertheless, diverse studies made by historians of law suggest a break of continuity. In this article both arguments will be analyzed in order to weaken those postulates that attempt to legitimize our law through a supposed historical evolution. This way, the reader can conceive law as a social product that obeys to a certain historical context.
