About the modulation power of the punitive action or the not well called “Principle of Opportunity”

Abstract
The present article sets out to provide some reasons to differentiate between a power from punitive modulation and the legal principles with the object of avoiding a mistreatment between structural and methodologically dissimilar concepts. For the development of this purpose a basic idea of legal principles is approached, its nature and functions are indicated and then a parallel is made with the not well called “principle of opportunity”. The result of the article is the necessity to indicate, under a dogmatic principialistic, that the “opportunity principle” is not a legal principle but a political power forehead to which the legal tools are due to fortify (legal methodology) to avoid its application against the law.
