João Hélio, Pasargada and the Formation of a New Culture in Brazil: Problems of Alterity and Fundamental Rights from the Point of View of Autopoietic Systems

Abstract

The object of this paper is to study the possibilities of two different legal environments living together from the point of view of a distinctive unity: Pasargada and The Law of the Asphalt. Using the case of the murdered child João Hélio as a background, it tries to check the reality of codes in Brazil’s legal system and the possibility of analysis based on the autopoietic theory and therefore of Recht and Unrecht as constitutive and transforming elements of legal systems.
