Abstract

This paper aims to focus on the essential foundations of competition law in Colombia, which is given by two aspects in general: i) on the one hand in relation to the constitutional mandate that requires the State to ensure free competition and, ii) second, the design and implementation of a clear public policy that promotes, develops and ensures that constitutional mandate. So, you will find first, a description of the regulatory framework that enables the state to intervene in the economy, taking aim we disaggregate the source on which is built the competition law in our country. Secondly, we will address both fundamental role of economic regulation in the maintenance of economic and social order, as public policy designed by the State to fulfill its functions in terms of competition.
