The International Court of Justice before the palestinian-israeli conflict

Abstract
Forty years of Israeli occupation in Palestine have caused serious violations to international law, and the diplomatic negotiations regarding the conflict have lacked of an appropriate legal framework. Through the case system, in this article it will be evaluated the role played by the International Court of Justice in its advisory opinion concerning the building of a wall in Palestinian territory. From the analysis of this decision of the highest international tribunal, it can be affirmed the pertinence of the judicial recourse in an international conflict throwing away the artificial division between justiciable and non justiciable disputes.
