WHAT DO WE UNDERSTAND BY RESPONSABILITY IN THE MEDICAL ACTION? A REFLECTION FROM THE PERSPECTIVE OF BIOLAW

Abstract

When we are dealing with valuing a conduct that has caused lots of pain, inevitably we appeal to elements of judgment belonging to Law. However, can we appeal to the same elements when valuing the conducts in which the medical staff engages in within the frame of medical actions? Or, bearing in mind not only the considerable progress achieved by medical sciences in the last few years, but also that medical care is provided within a complex system of social security that is responsible for regulating the provision of medical care in Colombia: can it be that the elements provided by Law in such an inspection are insufficient?
