Abstract

Through this article will be analyzed the State responsibility for imposing limitations to real estate property in urban areas that affect the essence of this right: the use and enjoyment. In first place, it will be described the legal answer contained in the 37 article of law 9/89. As a complement of what has been just said, it will be studied the legal mechanism of free transferences done using forced routes, used by municipality to evade the responsibility derived of the limitations imposed to property.
