Between analytics and hermeneutics: the legal philosophy as practical philosophy

Abstract

The author studies the main characters of the analytic approach to legal philosophy, mainly, the one that has recently taken place in Italy. He compares this approach with the critiques and proposals put forward by different representatives of hermeneutics philosophy. Later in the paper, the author proposes, as an overcoming of the aphorias expressed by these two schools, a reformulation of the classical iusnaturalistic approach to the main problems that, nowadays, are posed to the philosophy of law.
