Derecho de supresión en modelos de inteligencia artificial generativa: estándar de neutralización funcional

El entrenamiento de modelos de inteligencia artificial generativa ha transformado los desafíos del derecho a la protección de datos frente a sistemas cuyo funcionamiento dificulta la eliminación de la información. En ese contexto, el objetivo de este artículo es analizar el alcance jurídico del derecho de supresión previsto en el artículo 17 del Reglamento General de Protección de Datos (RGPD) cuando los datos personales han sido incorporados al entrenamiento de un modelo de inteligencia artificial generativa. La investigación adoptó un enfoque cualitativo de carácter documental, inscrito en la dogmática jurídica y sustentado en un paradigma interpretativo. El análisis muestra que la inviabilidad técnica de la eliminación material no constituye una excepción autónoma al derecho de supresión. Para tal fin, se propone un estándar de neutralización funcional verificable, basado en un test de no reproducibilidad, no inferibilidad y proporcionalidad de esfuerzo requerido. Se concluye que la obligación de supresión conserva su carácter imperativo, mientras la neutralización funcional resulta compatible con el derecho cuando garantiza resultados verificables, minimiza el riesgo de identificación y permanece sometida a documentación, auditoría y control.
